Residents are raising concerns about pervasive noise pollution and diminishing property values, which they attribute to these high-tech facilities.

Residents File Lawsuit Against xAI and SpaceX for Noise Pollution from AI Data Centers

In Oxford, Mississippi, three concerned citizens have initiated a proposed class-action lawsuit against xAI, SpaceX, and MZX Tech. The plaintiffs contend that a power facility, integral to the operation of AI data centers in the Southaven vicinity, emits incessant noise and vibrations. According to the court filing, this disturbance is "omnipresent and inescapable," permeating their residences and disrupting the tranquility they once enjoyed. The lawsuit seeks restitution for emotional distress, reduced property values, and other alleged damages, potentially affecting over 10,000 local inhabitants. While Elon Musk himself is not directly named as a defendant, the legal action implicates his prominent companies. This development, which came to light on a recent Tuesday and was first reported by Reuters, has yet to elicit a response from SpaceX or xAI to Benzinga's inquiries.

This legal challenge in Mississippi is not an isolated incident but rather a reflection of a burgeoning nationwide resistance to AI data center projects. Earlier this April, in Festus, Missouri, local voters demonstrated their disapproval of a proposed $6 billion AI data center, resulting in the ousting of four city council members who had initially approved the project. Similarly, officials in New Brunswick opted to reject a data center proposal in favor of developing a public park, and Prince George's County temporarily halted similar projects due to widespread community opposition. The scrutiny of AI infrastructure has even reached the federal level. Earlier this year, Senator Bernie Sanders (I-Vt.) and Representative Alexandria Ocasio-Cortez (D-N.Y.) introduced the AI Data Center Moratorium Act, aiming to impose a nationwide moratorium on new data center constructions. Furthermore, xAI is already confronting a separate lawsuit from the NAACP, which alleges environmental violations connected to its Mississippi operations. This particular case has garnered the attention of the U.S. Justice Department, given its potential to set significant precedents for AI infrastructure policy.

The increasing number of lawsuits and public opposition highlights a critical need for transparent dialogue and responsible development in the AI industry. As technology continues to advance, the environmental and social impacts of its supporting infrastructure must be carefully considered and mitigated to foster sustainable growth and maintain community well-being. This ongoing debate underscores the importance of balancing technological progress with the legitimate concerns of affected communities, urging tech giants to adopt more community-centric approaches in their expansion strategies.
